Waivers/Agreements

All riders must sign our agreement at check in. Which means adding people that are not included on the waiver by picking them up at the shore or beach breaks the terms of the contract. In doing so, this destroys our equipment, you will lose your security deposit, pay for damages, and the downtime our machine could be rented. Additional riders rate- $10.00 per rider, security deposit $250.00.

THE MARINA IS A NO WAKE ZONE- WE HAVE ZERO TOLERANCE FOR SPEEDING THROUGH THE MARINA- YOU WILL LOSE YOUR SECURITY DEPOSIT AND BE FINED $500.00. WITH ADDITIONAL FINES FROM THE MARINA.

BULA COAST WATER SPORTS LLC agrees to rent the following personal watercraft (the “Craft) to Renter(s), upon the condition that Renter(s) agrees to ALL TERMS and CONDITIONS set forth including the release of claims and agrees to FOLLOW OUR SAFETY INSTRUCTIONS & EVIDENCES THAT AGREEMENT WITH SIGNATURE(S) BELOW

ALL RIDERS MUST SIGN OR THIS CONTRACT IS VOIDED LOSING SECURITY DEPOSIT

ANY BEACHED/CLOSE TO SHORE JET SKI WILL LOSE THE SECURITY DEPOSIT AND WILL NOT BE RETURNED

The Craft shall be rented for the time period listed and hourly rate specified.

 

SAFETY INSTRUCTIONS & REGULATIONS

 

1. Operator and passengers must wear personal floatation devices at all times.

2. NEVER OPERATE THE WATERCRAFT WHILE OR AFTER CONSUMING ALCOHOL, OR TAKING DRUGS. (LEGAL OR ILLEGAL) OPERATING A WATERCRAFT UNDER THE INFLUENCE IS A FEDERAL OFFENSE SUBJECT TO FINES.

3. Stay away from designated swim areas and other hazards marked or unmarked.

4. Always watch for swimmers or divers in water. Avoid debris in water-will damage equipment.

5. Keep to the right when exiting the Marina until you are in open waters.

6. Maintain proper lookout at all times by sight & hearing to avoid collision.

7. Always be aware of the traffic around you. Sailboats, commercial vessels, & all other boats have the right of way. You must keep out of their way at all times and avoid crossing ahead of the other vessel. Take early and substantial action to keep well clear. You can change course, slow down or stop if necessary to avoid collision. Pass at a safe distance. If a head-on situation is arising, unless otherwise agreed, each shall alter course to starboard (RIGHT) and pass on the port (LEFT) side of the other.

8. Wake jumping is very dangerous and is prohibited.

9. Follow local regulations regarding speed limits, whether posted or not. The Geneva Marina is a NO WAKE ZONE. YOU ARE RESPONSIBLE FOR ANY AND ALL DAMAGES/ OR FINES THAT ARE A RESULT OF YOUR WAKE. THIS INCLUDES: DAMAGE TO OUR EQUIPMENT AND PROPERTY OR STAFF, THE MARINA AND PROPERTY OR STAFF, OR ANY OTHER BOATS OR EQUIPMENT IN THE MARINA, INCLUDING INJURIES TO OTHERS.

10. You must allow time and distance to slow down or stop the watercraft.

11. You must use the throttle to turn. The jet thrust is what makes you turn.

12. Jet Skis are in motion at all times, there is no neutral position.

13. Never go in low water, you can damage the jet pump & impeller of a Jet Ski while the engine is running.

14. Driver should always attach the engine stop switch to their Life Vest so that the engine stops if the driver falls off.

15. SHUT OFF JET SKI (NO POWER)!! Do not put hands, feet or clothing near the jet intake on the bottom of the Jet Ski while the engine is running.

16. To turn the Jet Ski to its upright position (NOT RUNNING/ NO POWER), you must rotate it CLOCKWISE by body weight bearing on the right side and grabbing the intake grate to complete the clockwise rotation. The Jet Ski will be severely damaged if you do not turn it over in a clockwise rotation. NOTES ARE ON THE SKI. YOU WILL BE RESPONSIBLE FOR DAMAGES.

17. If you fall off (WITH NO POWER/ SHUT OFF), board from the rear of the Jet Ski. Use the rear grab handle to pull your knees to the platform. Then pull yourself forward using the handlebar to maintain balance. Passengers should climb on the same way after the driver is on board. Reconnect safety switch & RESTART ENGINE.

18. ABSOLUTELY NO BEACHING OF THE WATERCRAFT IS ALLOWED! Stay 1000ft. from shore.

19. You must stay away at least 300ft. from all other Jet Ski's or Watercraft. DO NOT FOLLOW OTHER JET SKI's, stay to the side!

20. DO NOT BECOME AIRBORNE.

21. Allow yourself enough distance and always check for other watercraft before turning.

 

 

Release and Waiver of Claims

 

 

For valuable consideration, the receipt and sufficiency of which are hereby acknowledged Renter(s)  (and Passenger(s) if applicable) does hereby remise, release, and forever discharge Bula Coast Water Sports LLC, The Geneva Marina, the company’s agents, insurers, servants, successors, heirs, executors, administrators, and personal representatives, of and from all, and all manners of, actions, causes of action, suits, proceedings, debts, dues, contracts, judgements, damages, claims, and demands whatsoever in law or equity, which Renter ever had, now has, or which Renter’s heirs, executors, administrators or personal representatives hereafter can, shall, or may have for or by reason of any matter, cause, or thing whatsoever arising out of this Agreement; out of the use (misuse, or abuse) of the Craft; or in any way arising out of the rental relationship between the Renter(s)/Passenger(s) and Company (Bula Coast Water Sports LLC).

Indemnification

For good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, Renter (and Passenger(s) if applicable hereby expressly agrees to indemnify and hold harmless the Company (Bula Coast Water Sports LLC), Company’s agents, insurers, servants, successors, heirs, executors, administrators, and personal representatives against all suits, actions, claims, demands, or damages that arise out of Renter’s use, mis-use or abuse of the Craft.

 Photograph/Video Release

Participants hereby grant the Company, its representatives, and employees the right to take photographs/videos of the Renter(s) in connection with participation in the activities. The Renter(s) hereby authorizes the Company to copyright, use, and publish the same in print and/or electronically. The Renter(s) hereby agrees that the Company may use such photographs/videos of the Renter(s) for any lawful purpose, including but not limited to publicity, illustration, and advertising.

 

Terms and Conditions

 

1.            Assumption of Risk- Renter(s) (and Passenger(s), if applicable) acknowledges that the activities for which the Craft is designed include inherent dangers, including, but not limited to the risk of bodily injury and/or death arising out of misuse, swimming, diving, or other activities in, around, or relating to the Craft. Renter(s) (and Passenger(s) if appliable) assumes and accepts all risks associated with the use of the Craft. Company (Bula Coast Water Sports LLC) is neither the manufacturer nor a dealer of the Watercraft.  The Company has not made and does not make any representation, warranty, or covenant, expressed or implied, with respect to the condition, quality, durability, or suitability of the Watercraft.

2.            Qualified to Participate- Renter(s) agrees, acknowledges and represents that they are a good swimmer, is qualified, in good health, in proper physical condition to participate in this activity or in any activity arising from renting the Watercraft and signed the waiver.

3.            Acceptable Use- Renter(s) agrees and acknowledges that they will use the Craft in a careful, safe, and conscientious manner. Renter(s) shall at all times observe and adhere to any rules and guidelines posted by the Company and any applicable laws or regulations.

4.            Boundaries- Renter(s) agrees to operate the Craft within the designated boundaries set forth by Bula Coast Water Sports LLC. These are given verbally and will be posted.

5.    Prohibited Activities- Bula Coast Water Sports LLC reserves the right to cancel this rental agreement immediately if Renter(s) engages in any prohibited activity. Renter(s) shall not violate any of the following rules and regulations during their operation of the Craft:

                  

              NEVER OPERATE THE CRAFT AFTER OR WHILE CONSUMING ALCOHOLIC BEVERAGES OR DRUGS (LEGAL OR NOT LEGAL). THE COMPANY RESERVES THE RIGHT TO INSPECT ANY COOLERS, BAGS OR OTHER CONTAINERS BELONGING TO THE RENTER(S).

              There are NO additional passengers or additional drivers permitted on the Craft unless expressly permitted by Bula Coast Water Sports LLC in writing prior to use.

              Leaving the designated rental area, beaching or close to shore

              DO NOT FOLLOW other CRAFTS.

              Weaving through congested traffic.

              ROLLING OR SUBMERGING CRAFT

              THERE IS NO SMOKING ON OR NEAR THE CRAFT.

              THERE ARE NO PETS PERMITTED ON THE CRAFT.

              THERE IS NO FISHING PERMITTED ON THE CRAFT, AND NO SWIMMING

        PERMITTED FOR RENTER(S) DURING USE OF THE CRAFT.

              THERE IS NO DOCKING OF THE CRAFT AT ANY LOCATION OTHER THAN THE

        COMPANY’S DESIGNATED DOCKING AREA, EXCEPT IN THE CASE OF AN

        EMERGENCY.

 

6.    Age- Renter is at least 18 years of age for the Jet Ski rental. No one under the age of 18 is permitted to operate the Craft.

7.    Boater’s License- Renter(s) acknowledges that they have obtained a temporary or a regular Ohio Boaters license, in conformance with the ODNR regulations & requirements, if they are renting and operating a Jet Ski.

8.    Unsafe Use- If at any time, the Company determines that the Renter(s) has engaged in an unsafe or hazardous use of the Craft, Company may immediately terminate the rental. UPON NOTIFICATION OF THE RENTAL, Renter(s) must return the craft to the designated docking area immediately. If the rental is terminated for unsafe or hazardous use, Renter will not be refunded their security deposit. Company shall determine, in its sole discretion, whether any behavior or activity is “unsafe or hazardous”.

9.    Max Weight Limit- Sea Doo MAX COMBINED WEIGHT IS 600 LBS

10.    Condition of Craft upon Return- The Renter(s) shall return the Craft to the designated docking area clean, free of garbage and debris, and in the

same condition as it was in when given to the Renter(s), excepting ordinary wear and tear. Renter(s) shall be responsible for any damage caused to the Craft and/or Marina property or tenants during the rental period. The Company shall retain any portion (or all) of the Renter’s security deposit as necessary to cover repairs for such damages. To the extent that damages to the Craft exceed the amount of the security deposit, Renter(s) shall be billed by the Company for the full amount of damages caused by Renter(s) during the rental period. The Company shall be entitled to collect all costs and expenses of its collection actions or suit, including reasonable attorney fees. If renter(s) causes any damage that will result in lost rents, renter agrees to pay $200.00 per day for each full and partial day the Craft is removed from rental service for repair. Renter’s liability under the terms and provisions hereof is not limited in any manner to the liquidated damages set forth above the sum of the security deposit.

11.    Late Fee- If Renter(s) return the Craft to the designated docking area more than 5 minutes after scheduled “Time In”, renter agrees to be charged another hour at our normal hourly rate. If Renter(s) return the Craft more than 15 minutes after the scheduled “Time In” Renter shall forfeit their security deposit. A watch is provided for accuracy in return.

12.    Cancellations- The Company reserves the right to cancel due to inclement weather or impending bad weather. A full refund will be given if we cancel for weather conditions. If the Renter(s) cancels less than 48 hrs. in advance, no refund will be given. NO REFUNDS for NO SHOWS. Our SAFETY information must be conducted prior to rental, if you arrive late, with not enough time for procedure, NO REFUND will be given.

In the signing below, I certify that I am at least 18 yrs. of age, that I have fully read and understand all of the terms, conditions and rules set forth in this document and agree to all terms without reservation. I am voluntarily making this release and waiver of any liability for myself or a participant for whom I am legally responsible.

 

 

 

In signing below, I also acknowledge that I understand the safety instructions for myself or a participant for whom I am legally responsible. All Renter(s) above 18 must sign.

In signing below, I also acknowledge and fully understand the form titled “Safety Instructions & Regulations”. I acknowledge that I understand the safety instructions for personal watercraft operation as well as my financial obligations for responsible watercraft rental for myself, passenger(s) or a participant for whom I am legally responsible.

 

 

NOTE: (AT CHECK IN) THE CUSTOMER ACKNOWLEDGES PRIOR DAMAGES OF JET SKI

AND IS RESPONSIBLE FOR ANY NOT NOTED UPON RETURN- A PICTURE OF THE JET SKI BEFORE TAKING OUT AND AFTER RETURN WILL BE ON THE CHECK IN WAIVER.

 

 

 

 

SIGNATURES OF ALL PARTICIPANTS WILL BE REQUIRED ON THE INSURANCE FORMS AT RENTAL SITE. MINOR'S ARE TO BE SIGNED BY ADULTS TAKING THEM ON THE WATERCRAFT.

 

ALL ADDITIONAL DRIVERS/RIDERS WILL NEED TO COMPLETE THE WAIVER AND SHOW DRIVER’S LICENSE.
